divided into
peacefully existing Christian and Moslem communities, and

...it might hurt
its own law abiding fellow Americans and the improvised
families, relatives and friends they support and, sadly, the
children and families of our martyrs more than it would the
regime.
Eritrean-Americans, permanent residents, Eritreans
seeking asylum and Eritreans wishing to visit and immigrate to the
US have justifiable reasons to be more concerned about the threat
made by Jendayi E. Frazer, the assistant secretary of state for
African affairs, to
Add Eritrea to List of Nations Backing Terrorists than those
who reside in other parts of the world. One in South Africa or
Stockholm can not comprehend the consequence of such a decision on
the lives of Eritreans in the US. It might not be far
fetched when some say that if the State Department acts on
its threat, it might hurt its own law abiding fellow Americans and
the impoverished families, friends, and the children of martyrs
that they support more than it would the regime.

and livelihood of millions of Eritreans worth to you, Ms. Frazer? |

If
there such a heavy burden of proof, as indicated below, to
convince a US court that the an individual accused of crime is guilty
beyond a reasonable doubt, should'nt there be a higher
burden when the lives and
livelihood of millions of Eritreans is at stake?

Presumption
of innocence is a legal
right that the
accused in
criminal trials has in many modern nations. It states
that no person shall be considered guilty until finally
convicted by a court. The
burden of proof is thus on the
prosecution, which has to convince the court that the
accused is guilty beyond a reasonable doubt. In principle,
the defense does not have to 'prove' anything. However, the
defense may present evidence tending to show that there is a

Special Visa Processing Procedures - Travelers from State Sponsors
of Terrorism
Section 306 of the Enhanced Border Security and Visa Reform Act of
2002 (EBSVRA) pertains to the issuance of visas to aliens from
state sponsors of terrorism.
The language for Section 306 of the EBSVRA in pertinent part
follows:
No nonimmigrant visa under Section 101(a)(15) of the Immigration
and Nationality Act (8 U.S.C. 1101(a)(15)) shall be issued to any
alien from a country that is a state sponsor of international
terrorism unless the Secretary of State determines, in
consultation with the Attorney General and the heads of other
appropriate United States agencies, that such alien does not pose
a threat to the safety or national security of the United States.
In making a determination under this sub-section, the Secretary of
State shall apply standards developed by the Secretary of State,
in consultation with the Attorney General and the heads of other
appropriate
United States
agencies, that are applicable to the nationals of such states. |

terrorism -- it's very hard to get off.

Coordinator for Counterterrorism:
State sponsors of terrorism provide critical
support to non-state terrorist groups. Without state sponsors,
terrorist groups would have much more difficulty obtaining the
funds, weapons, materials, and secure areas they require to plan
and conduct operations. Most worrisome is
that some of these countries also have the capability to
manufacture WMD and other destabilizing technologies that can get
into the hands of terrorists. The United States will
continue to insist that these countries end the support they give
to terrorist groups. |
